Terms of Service

You must be at least 18 years old to create or use a PostWhim account.

If you use PostWhim on behalf of a business or organization, you represent that you have authority to act on behalf of that organization.

PostWhim provides AI-assisted tools designed to help creators, entrepreneurs, and businesses plan and create social-media content.

Features may include:

• AI-assisted content generation
• Captions and hooks
• Content ideas
• Content calendars
• Weekly planning
• Brand Voice personalization
• PostWhim Insights
• Content budgeting
• AI-assisted chat
• Related content-management tools

Features may be added, changed, improved, limited, or discontinued over time.

You are responsible for:

• Providing accurate account information
• Maintaining the confidentiality of your login credentials
• Activity occurring through your account
• Promptly notifying PostWhim of suspected unauthorized access

You may not access another person’s account without authorization.

You retain your rights in the original content and information you submit to PostWhim, subject to any rights belonging to third parties.

You grant PostWhim a limited license to host, process, transmit, reproduce, and otherwise use your submitted content only as reasonably necessary to operate, secure, support, and provide the Service and its features.

You represent that you have the rights necessary to submit content you provide to PostWhim.

PostWhim uses artificial intelligence.

AI-generated content may be inaccurate, incomplete, inappropriate, repetitive, outdated, or unsuitable for your particular circumstances.

PostWhim does not guarantee that AI-generated content:

• Is accurate
• Is unique
• Will increase followers, engagement, traffic, revenue, or sales
• Will perform successfully on any social-media platform
• Is free of third-party rights
• Is appropriate for every business or audience

You are responsible for reviewing, editing, verifying, and approving content before publishing or relying on it.

PostWhim is a content-assistance tool and does not replace professional legal, financial, medical, tax, or other professional advice.

The PostWhim service, branding, design, software, interfaces, logos, and other proprietary materials are owned by Chalbiz Worldwide LLC or its licensors and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of PostWhim’s platform or intellectual property to users.

User-submitted content remains subject to Section 4.

You may not use PostWhim to:

• Violate applicable law
• Infringe intellectual-property or privacy rights
• Access another user's account or data
• Attempt to bypass authentication or subscription limits
• Abuse, attack, disrupt, probe, scrape, reverse engineer, or interfere with the Service except where applicable law expressly permits otherwise
• Use automated systems to make excessive or abusive requests
• Introduce malware or malicious code
• Commit fraud or impersonate another person
• Generate or distribute unlawful content
• Use PostWhim in a manner that creates unreasonable technical or financial burden on the Service

We may restrict or suspend accounts involved in misuse, fraud, security threats, or material violations of these Terms.

PostWhim may offer paid subscription plans with specified AI usage allowances and features.

AI generation limits may differ by plan.

Usage allowances apply to the applicable billing period and do not necessarily carry over to future billing periods.

Attempting to bypass usage limits or manipulate usage records is prohibited.

Current plan details are displayed on PostWhim’s pricing page.

Additional subscription terms are described in the Subscription & Cancellation Policy, which forms part of these Terms.

PostWhim relies on third-party technology and infrastructure, which may include Lovable, Supabase, OpenAI, Google, and future payment providers.

Third-party services may experience interruptions, changes, or outages outside PostWhim’s control.

Your use of certain integrations may also be subject to the applicable provider’s terms.

We work to provide a reliable Service, but PostWhim is not guaranteed to be uninterrupted, error-free, or continuously available.

We may perform maintenance, update features, correct errors, or temporarily restrict access when reasonably necessary.

You may stop using PostWhim at any time.

You may permanently delete your account through Settings.

We may suspend or terminate access when reasonably necessary because of fraud, security risks, nonpayment, misuse, legal requirements, or material violations of these Terms.

Account deletion is permanent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTWHIM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

CHALBIZ WORLDWIDE LLC DISCLAIMS WARRANTIES THAT ARE NOT EXPRESSLY REQUIRED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHALBIZ WORLDWIDE LLC AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO POSTWHIM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHALBIZ WORLDWIDE LLC’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO POSTWHIM DURING THE SIX MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

(B) $50.

These limitations apply only to the extent permitted by applicable law.

To the extent permitted by law, you agree to indemnify and hold harmless Chalbiz Worldwide LLC from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of PostWhim, your violation of these Terms, or content you submit that infringes another person’s rights.

PostWhim may evolve over time.

We may update these Terms when reasonably necessary because of new features, legal requirements, security needs, business changes, or changes to third-party services.

Material changes may be communicated through the Service or another reasonable method.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in these Terms deprives consumers of mandatory protections available under applicable law.
